iMapAlert Terms and Conditions.

1.	By signing up for iMapAlert, you are entering an agreement between Weather Decision Technologies ("WDT"), and you, the end-user Customer. This Agreement provides for certain weather forecasts and alerts sent to your e-mail address or SMS device. 

2.	For help with the iMapAlert product, please contact WDT Support at support@wdtinc.com. 

3.	Licensed Not Sold. The weather forecasts and hazardous condition alert contents are licensed, not sold, to you by WDT for use only under the terms of this License, and WDT reserves any rights not expressly granted to you. Commercial distribution and all other uses of the weather forecasts and the optional hazardous condition alerts are restricted without permission of WDT. 

4.	No Warranties. The weather forecasts and the hazardous condition alerts are provided "as is." WDT or the end user makes no representations or warranties of any kind with respect to the weather forecasts and optional hazardous conditions alerts, and expressly disclaims any and all warranties, either expressed or implied, including, but not limited to, warranties of merchantability or fitness for a particular purpose and any/other implied warranties regarding the capabilities, utility, and business or commercial applications of same. 

5.	Limitation of Liability. In no event shall WDT, its agents or employees, or the end user, and any affiliated companies and their agents, employees and directors be liable for any special, incidental, consequential or other damages whatsoever, (including, without limitation, damages for loss of business information, or other pecuniary loss) arising out of the use of or inability to use the weather and hazardous conditions alerts, even if WDT or the end user have been advised of the possibility of such damages. 

6.	Termination. This License shall terminate immediately and without notice if you violate any part of this License. 

7.	Laws. The laws of the State of Oklahoma govern this License. If for any reason a court of competent jurisdiction finds any provision of this License, or portion thereof, to be unenforceable, that provision of the License shall be enforced to the maximum extent permissible so as to affect the intent of the parties, and the remainder of this License shall continue in full force and effect.

9.	Force Majeure. If either party is delayed at any time in the progress or performance of this Agreement or is prohibited from fulfillment of its obligations under this Agreement due to labor disputes, fire, unusual delays in delivery, unavoidable casualties, terrorist attacks, national emergency, marshal law, acts of God, or other causes beyond the party's reasonable control, such delay shall not be construed as a breach of this Agreement. 

10.	Disclaimer of all Warranties/Limitations of Damages. WDT and the end user make no representation or warranty, express or implied, with respect to the accuracy, usefulness or completeness of the WDT Data and Services or other products or services that may be provided under this Agreement, or the fitness or merchantability of WDT Data and Services, for any purpose, or other services that may be provided under this Agreement. WDT and the end user shall have no liability for any consequential damages, incidental damages or other indirect or special damage or loss, such as, but not limited to, loss of life or injury to personal property damage, loss of revenue and/or goodwill, loss of any business opportunities or the use of plant or equipment, or loss of employee time or productivity, regardless of whether any of the parties has or had notice of the possibility of such damages or injuries. 

11.	Application of these Weather and Hazardous Conditions Alerts. Experience has shown that the resolution, timeliness, and format in which data for weather forecasts and the optional hazardous conditions are presented within various displays and products, does not provide a total solution with regard to addressing concerns regarding the presence of hazardous weather (including lightning) or other hazardous conditions and their potential impact on the safety of personnel and/or safeguarding of facilities, whether it be of immediate or short term concern. Interpretation and application of the data, as well as any comparative analysis and/or prognosis or similar activities done by any user, are done so solely at the user's risk and have not directly or indirectly been implied, condoned or recommended by WDT or their suppliers. 

12.	SMS Messaging. This service can include messages being sent via Simple Message Service (SMS) via cell phone carriers. Messages sent via this method will be subject billing/pricing per your agreement with your cell phone carrier. 

13.	Legal Agreement. This is a legal agreement between you (the end user) and WDT, covering your use of the weather forecasts and the hazardous conditions (including lightning) notification services. Be sure to read this agreement before using this service. By using the alerting service or clicking the "Accept" button, you agree to be bound by the terms of this License. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT USE.
